1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Qlens mobile application, website at https://qlens.kaanalabs.me, and related services (collectively, the "Service") operated by Kaana Labs ("we," "us," or "our").

By downloading, installing, or using Qlens, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Service Description

Qlens is a mobile application that provides QR code and barcode scanning, QR code generation, scan history management, and related utility features. The App is available on Android via Google Play.

We offer a free tier supported by advertising, and a Qlens Pro paid tier with enhanced features and no advertisements. Features may change over time at our discretion.

3. Eligibility

You must be at least 13 years of age (or the minimum digital age of consent in your country, whichever is higher) to use Qlens. By using the Service, you represent that you meet this requirement.

If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account Registration & Qlens Pro

4.1 Account Registration

Some features (including Qlens Pro) require you to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the security of your login credentials.

4.2 Qlens Pro Subscription

Qlens Pro is a recurring paid subscription. By purchasing a Pro subscription, you agree to the following:

• Subscription fees are billed in advance on a monthly or annual basis
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can cancel your subscription at any time through your Google Play account settings
• No refunds are provided for partial subscription periods, except where required by law
• We reserve the right to change Pro pricing with 30 days' notice

4.3 Free Trial

If we offer a free trial of Qlens Pro, your subscription will automatically convert to a paid subscription at the end of the trial unless you cancel before the trial ends.

5. Acceptable Use

You agree to use Qlens only for lawful purposes. You must not use the App to:

• Scan QR codes for phishing, fraud, or malicious purposes
• Generate QR codes containing illegal, harmful, or deceptive content
• Violate any applicable local, national, or international law or regulation
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Interfere with or disrupt the integrity of the Service or its infrastructure
• Attempt to gain unauthorised access to any system or network
• Use the Service to distribute malware, spam, or unauthorised advertising
• Misrepresent your identity or impersonate any person or entity

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Intellectual Property

6.1 Our Property

Qlens, including its name, logo, design, code, features, and content, is owned by Kaana Labs and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

6.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use Qlens for your personal, non-commercial use in accordance with these Terms.

6.3 Your Content

You retain ownership of any content you create using Qlens (e.g., custom QR codes). By using the Service, you grant us a limited licence to process and store that content solely to provide the Service to you.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or completely secure. We are not responsible for the content of any QR codes scanned through the App.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KAANA LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ₦10,000 (TEN THOUSAND NAIRA), WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kaana Labs and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, if we believe you have violated these Terms or for any other business reason.

You may stop using the Service and delete the App at any time. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and governing law) shall survive.

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or by email (if you have an account) at least 14 days before the changes take effect.

Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
